Appeals Court Judge Patrick McAnany wrote in the unanimous opinion.


SAN DIEGO - Nearly a year after Congress passed legislation calling for the construction of 700 miles of new fencing along the U.S.-Mexico border, about 15 miles have been built, according to the Department of Homeland Security.

Bush signed the Secure Fence Act last autumn in hopes that bolstered enforcement would lead the then-Republican-led Congress to pass a broader immigration overhaul.

The plan calls for much of the fencing to be built by the National Guard. But with the administration reducing the number of guard troops on the border by half, to 3,000, by October, labor could be in short supply.

In Response to the final thought expressed in the video above:

I must correct Hernandez on one point. This, America, is a "conquered occupied nation". Whether the Spaniards, French, and other European gangs stole parts of "the new world" from Mexico or not is beside the point. What is certain is that natives resided here for at least centuries when all of a sudden the European gangs, later to be called Americans, gave them smallpox, killed their livestock, filled them with gunpowder, and stole their property.

I mentioned the "new world". Anytime anyone anywhere, especially in a book, uses that term they are slapping my native brothers and sisters square in the face. That presumptuous, arrogant, dishonest assertion marginalizes the legitimacy of "Indian" society, government, and language. This term is evidence of America's pathological behavior towards native people.

The term "new world" asserts that the natives never existed. Or that their existence is not worth mentioning. You may as well pull a George Washington and call them "savages".

If it truly were a war on terror they'd arrest the KKK.
